What are my legal rights against someone who purchased my car and has now stopped making payments?
Question Details:
Sold car to friend for $1100. Took to mechanic before sale. Made $100 deposit. Transferred title. Drove car for a few months. Car broke down. Friend said too much to repair. Won't pay balance due. Nothing in writing. Asked for car back. Friend then said car would be junked and did it. Doesn't feel should pay anything. What legal action can I do? Can I get the balance without anything in writing?
You can sue in small claims court for the $1000, based on the verbal contract you do have. I can't guarantee success with that; a lot will depend on whether your friend is willing to lie under oath and, if so, just how convincing he would be.
We want to trust our friends, and sometimes people are insulted if you ask for an agreement to be put in writing. But this is the kind of situation that can result, and sometimes it's better to just not do business with friends, if the friendship is more important than the business.
