How do I try to recoup Social Security benefits that were wrongfully collected by another party?

Question Details:

When my oldest son came to live with me in 4/07 after living with his aunt for a period of a year, we found out the father had been getting payments from social security on him and his brother for about 5 years. The father never told anyone. We found out when I had to file for Hoosier Healthwise and was denied because of income we were not receiving. I went to SS and became the designated payee. The SS office was not surprised and said they would follow it through. 2 years later nothing has been done. Is there a way to get the money from the father that he took from my son during that time?
