Should an engagement ring be returned if the woman broke off the engagement?

She broke off the engagement after she upgraded it to a bigger ring. She and her grandmother invested $1000.00 for the upgrade. The value of the ring is now over $3000.00 for small claims. How do we legally get the ring back, and is she entitled to her money back? My son's ring he gave her was returned and she is refusing to give back the ring due to her recent investment. We live in Indiana. What is our legal course, and are we entitled to this "new" upgraded ring? Engagement was broke off because she said he wasn't religious enough?
The law in most states is that the girl is required to return the engagement ring where she breaks the promise to marry. Indeed, the ring was given in exchange for the promise to marry and is an enforceable/recogizable contract. The fact that the girl make the upgrade, does not change the fact that your son is able to have the ring back - i.e. the value that he paid. I suggest that you file a lawsuit in small claims court that seeks $2000 in compensatory damages. before you file suit however, i suggest that you provide the girl with a letter indicating (from a lawyer that you hire) that she is being given a last opportunity to return the ring before a lawsuit is filed. this way, you look like the good guy in court when you sue her for the value of the ring. make sure you hire a lawyer to represent you in court. most lawyer should represent you for the day in court for $400.00.
