Should I sue for an injury due to improperly stocked/shelved items?
Question Details:
I was at Publix one day and they had a case of 4-packs of soda stacked on top of one another. One fell on my foot, cracked my toe nail, and I got 2 bruises on my leg. Pepsi apparently stocked them, and they want me to sign a release form saying they will give me $200.00 if I don't sue them. I don't think that's good enough. The lady at Pepsi said they stocked them the way Publix wanted them to. I haven't gone back to Publix since then. I went to another store the other day and saw that they stock them one on each shelf. Should I sign the release form? Or should I sue Pulbix, Pepsi, or both?
Why do you think the case is worth more than $200? Did you incure more than $200 of medical care (or lost wages)? Have you suffered permanent disability? Civil lawsuits compensate people for their losses or damages; generally speaking, unless the conduct was so "bad" as to make punative damages appropriate (which this was definitely not), the amount you can win is related to your injury and out-of-pocket losses. If you have not suffered significantly more than $200 of costs, or have not suffered a permanent disability, $200 is actually generous for a toenail and two bruises.

Are you a lawyer?
