Should I be worried about a summary judgement against me?
Question Details:
I received a summary judgement against me and my spouse. What does this mean for me and how do I respond or fight against it?
A motion for summary judgment is a civil pleading that is filed. the motion basically says that there is no genuine issue of material fact in dispute in connection with this case and that they are entitled to a judgment against you as a matter of state law. if the court grants the motion, the creditor/moving party will be able to execute on the judgment, including but not limited to garnishing wages, liening your home, taking money from your bank account, etc. The way to respond to this motion is to provide an objection that demonstrates that there is at least 1 fact in dispute regarding the moving party's claim. i am guessing that the motion is made in connection with a debt, such as a foreclosure action or a credit card company is suing to collect money. you need to hire a lawyer to respond to this motion as it is complicated. if you can talk to the lawyer that filed the motion, then you may be able to resolve the case and have the motion not go forward. make an appointment to meet with a lawyer. most lawyers will meet with you initially for free.

Are you a lawyer?
