Question Details: Finally got a copy of settlement agreed to by my lawyer and taxi att'y. Settlement shows 1/3rd payment within 45 days of signing release (oct.2nd.09), another 1/3rd. 30 days after first payment, and final 1/3rd 60 days after receipt of 1st payment. My lawyer tells me this is normal in 90% of cases involving taxi company, since cab co. is solely responsible for payment. Language of stipulation doesn't say anything about business days only. Am I to assume 45 days includes weekends, so that 1st payment rec'd around Nov. 16th, 2nd payment Dec 16th, and final payment around Jan. 16th?

I am a lawyer in CT and practice in this area of the law.  Usually, 45 days doesn not mean  business days unless stated in the document or if the document is governed by state or federal law.  however,  it is a good rule of thumb to interpret 45 days as busienss days because if the payment is received late, your claim is stong that the other party has no excuse for being later.  In your case, i suggest using business days for the purposes of settlment.  there is no practical reason to make a big deal over a few days anyway given the fact that you are receiving money.
