Question: Divorce, Marriage, Alimony - Georgia

Asked on 10/25/2009
Seeking Custodial Change of Minor Child
We have joint custody of our minor child--each parent has her 50% of the time. In the past year, her Mother has gotten a DUI, been in a physically violent relationship (with our daughter present), moved 5 times in 3 years, and most recently has become a stripper. During "her" week with our daughter, said child is usually "farmed out" to relatives OR friends so my ex-wife can work (strip club). Additionally, our child has fallen behind in school, and has not had her homework in 3 out of 4 weeks with her mother. Do we have any legal grounds to request she reside with my me?

Depending on how long ago your divorce was filed, I would strongly suggest that you file a custody modification.  It sounds like your child needs to be in another person's care.  It's up to you whether or not that is you or if DFCS should get involved.
