I was involved in an accident yesterday and want to know if I should bother to fight the ticket because the cop said I was at fault?

I just moved to FL. and I was involved in a car accident. The cop said I was at fault and gave me a ticket. I was pulling out onto a four lane highway. I wanted to go south. I already crossed two north bound lanes, and when I looked I saw nothing coming so I made a left turn. In the far left lane going south out of nowhere this big white truck hit me. The police were called andthey said that I was at fault. It was a right-of-way issue. I disagree. Should I hire a lawyer and fight this or pay the ticket? I am a senior on SS and don't have the money.

Failure to give the right of way is one of the most common charges that polices officers give out on the highway.  they often claim that the merging car is at fault as a rule of thumb.  while this is unfair, it places a burden on the merging driver to be extra careful.  While you may be right as far as fault is concerned, the issue is whether it makes sense from a financial perspective to fight this.  The police report is likely going to influence a court that you were at fault and unless you have serious injuries, you are not going to get that much money from the court if you win as most of the money will go towards a legal fee.  i suggest that you refer this to your insurance company to fix the damages.  as far as court is concerned, plead not guilty to the ticket and try to get the state to dismiss it since you have insurance and both motor vehicles will be fixed with insurance money.  usually the state will work with you.  you can hire a lawyer for $700 to resolve the ticket to make sure the points are not assesed to your license.
