Question Details:
My husband got a credit card in his name only. He passed away the beginning of the year. Am I still responsible to pay off the balance on his card? I was told any bill in his name only I should not be responsible for. Is this correct?
Contracts are enforceable against the parties that sign then with the intent to be bound by the terms and conditions agreed on. In community property states, a spouse may be held liable for their spouse's debts. However, in the state that you live in it may not be a community property state which is why you were give the advice you got. If you do not live in a community property state, then the debt against your deceased husband is not enforceable against you because you were not a party to the contract. I suggest that you notify the creditor that your husband past away so that they close the account. You should not be exposed to any liability. However, if you are served with a collection lawsuit, you should bring it to a lawyer immediately.
