Regarding my father's bank account:
My father passed last year in October, he has a bank account, and no one else is listed on it, I paid for the funeral, he had not will, I was in the process of getting documentation for me to handle his affairs. He has no home, no bills, no car, nothing, this is all that he had when he passed. What do I have to do in order to get the money out of the bank without having to go through probate?

You may contact the bank to determine thier requirements.  If there is no beneficiary and no joint owner of the account, it should have to go through probate.  There is a simplified process if the account is less than $18,000.00.  If your father's estate qualifies for the simplified process,  take the death certificate and the paid reciepts from the funeral to the probate court in the county where he lived.  If you would like to discuss this matter in more detail, contact me at 586-868-5100.  John R.
