Question: Bankruptcy - Florida

Asked on 11/4/2009

Receiced a Default Final Judgment notice from the creditor.

I received a Default Final Judgement in the mail on October 15th. The letter states that I owe a specific amount. This is from a creditor that has taken me to small claims court once before. I am in the process of going bankrupt. I just did my pre-bankruptcy counseling session today. I was wondering how I go about responding to this judgement? I have no income (I have not worked since January); I have zero assets.

You'll include this judgment on your "matrix" of creditors, for the bankruptcy, when you file it.  When you do file the bankruptcy, that puts an automatic "stay" on any other legal action against you, including any attempt to collect on that judgment.  The creditor will have to take what they get in the bankruptcy;  when the discharge is entered at the end of the bankruptcy, that is the end of the judgment, whether paid in full or not.
