If I was rear-ended by an insured driver, isn't his insurer liable to pay for all costs of a rental car for my use until my car is paid for or replaced?

Did you talk to the insurance company? Did they refuse to pay your rental car? Most insurance companies will cover this. Otherwise how could you get around?
