What are my rights?

I have been living in the marital home for now 3 1/2 years and making the house payments on time without his help. Now he wants to kick me out and sell the home even though I refinanced and offered to buy him out. Can he legally kick me out even though I have been making the payments?

Generally, it depends on how the house is titled. Was it titled individually to one of you before the marriage? If it was acquired during the marriage, was it acquired using funds that came from outside or before the marriage? If you are truly tenants by the entirety as a married couple, it would be difficult for him to "kick" you out.
