Question: Auto Accidents - New York

Asked on 8/9/2009
Raised manhole due to construction damaged my car. What should i do?
When road construction is done to repave the streets, often times manhole covers are raised, I drove along the right lane of the FDR drive yesterday and my oil pan was damaged, I was leaking oil everywhere and could no longer drive the car. After gettting my car towed, the driver told me im his 6th victim today from the same road. What legal actions can i take against the city? Should i contact my insurance company, if so will my premium raise?

AttorneyPages has verified that this person is an attorney.

In order to make a claim against NYC you will have to file a notice of claim within 90 days.

If the city does not answer within 30 days you can then sue them in Small Claims Court.

A suit must be started within one year and ninety days from the date of the accident.

If you have coverage you would be better off dealing with your own insurance company.
