Question: Divorce, Marriage, Alimony - Ohio

Asked on 9/22/2009
Quit Claim deed of house from wife.
Divorce was final in May 09 and stated that ex-wife had all rights to the home but within 12months if she failed to maintain the mortgage on her own, I would have 30-days to take possession and begin paying the mortgage. She hasn't made a payment since June, and won't leave even though she told me she wanted to give me the house back at the end of July. The decree states she must transfer ownership via quit claim 30 days from her notifying me of giving up. What can I do?

AttorneyPages has verified that this person is an attorney.

File a motion to show cause in the court that made the orders regarding the house. Also expect that you will be refinancing the mortgage if she is listed on it.
