If you quit a job after 4 days and continued to claim unemployment, is that fraud?

Question Details:

I had been receiving unemployment then took a job and quit 4 days later because I believed their practices to be unethical and went back to claiming unemployment. That was in November 2008. I get a call tonight stating that WI can sue me for fraud because I quit a job and continued to file. What happens if they sue me? Does this happen often? I didn't realize I had done anything wrong.

If you are on unemployment and you get a job, you are no longer entitled to unemployment.  In this case, you were receiving unemployment.  When you got a new job, the unemployment benefits stopped (or should have stopped) since you were no longer unemployed.  When you voluntarily quit a job becasue you do not agree with their employment practices, you are not entitled to unemployment (except in rare circumstances).  If you were asked to do something illegal at this job and quit or were given duties that you were not hired to do, then you may have valid grounds to seek unemployment. If you are sued, the state may recoup the money that it paid you and possibly fine you.  Your ignorance of the law is not a good defense.  I suggest that if you are sued or recieve documents from the state threatening adverse action, that you immediately hire a lawyer to get involved. In my experience, states sue people as they see fit and takes fraud relating very seriously.
