question about subrogation as it pertains to a personal injury settlement

Question Details: Our daughter in law was killed in an auto accident 12/24/09. Our son's insurance co. paid a 3K death benefit,all medical costs/ambulance fees and paid off the auto loan on the totaled vehicle. The at fault driver's insurance co is now offering a $100K settlement (the policy's maximum) to him. Q) Will his insurance company be entitled to claim part of this settlement to reimburse them for the payments made on his behalf (he lives in Michigan, where the accident occurred)

We would need to review his insurance policy to be able to provide an accurate answer. Also, before settling with the at fault driver insurance company, I would want to make sure the at fault driver did not have any other insurance or significant assets  or significant income possibilities from a  job, inheritance other source.    Does your son have any children????  I would  not sign any papers without an attorney reviewing them on your son's behalf.
