Question Details: divorced 1992 decree states...the court shal file a qdro... called attorney 2009 to find out how this works if he retires--she said qdro was never filed and i would have to pay to have it done my ex paid all attorney, court etc, so i have no proof it was paid and i do not have the financial means to pay, no legal aid will help me i told her it was the attorney responsibility to see everything was completed why does decree say court will file, does that mean it may be okay since its in the decree this is a major source of income i counted on and now they tell me this help appreciated
It is not necessarily the attorney's responsibility to make sure the QDRO is filed. What does the final court order state? The COURT does not prepare the QDRO. Who does the court order to prepare the QDRO? If it is your ex then file a motion to show cause as it was never filed.
