Divorced 12/24/99. Ordered to split retirement. Would that be retirement to the date of divorce or all retirement?
As you know, dividing retirement benefits requires a court order. A QDRO directs a retirement plan administrator to distribute the benefits of a retirement plan according to the percentages agreed upon by the parties and approved by the court. The divorce settlement that you agreed upon or that the court ordered after a trial on the issue of property distribution should clearly state the terms and who what and when. If it does not, then you will need to request that the court clarify the issue. If the QDRO is not correct then the court will not sign it.
