Question: DUI / DWI Traffic - Michigan

Asked on 11/18/2009

Can I be stopped by the police for one thing and then arrested for another?

I made a right hand turn out of parking lot and left onto a main street. Police pulled me over and indicated that I made a illegal turn and that is why he pulled me over. But in fact, it was a legal turn. You can't make a left out of the parking lot. Ultimately, arrested for driving under the influence. Blew .18 but passed all the field sobriety tests. The fact I was pulled over on a false accusation, can I bring that up in court or will it help me with a lesser charge?

Th police need  a legitimate reason to pull you over and if their reason fails, any evidence obtained from the stop ( like Breathalyzer results) is Inadmissible.  This bears on complicated legal issues though. If you would like assistance please call :  (586) 268-2400
