Public Intoxication, Alabama

Question Details: I was taken to jail this weekend for public intoxication while waiting for a ride. They did not do a field sobriety test or a breathalyzer. I was not told my rights or even what I was being arrested for, the guy at the bail bonds place told me I should get a lawyer but I'm not sure if there is any point. Really what I want to know is when i go to court will I have to pay fines and how much are they? Is is possible for them to give me probation. I am also only 19, can they add a charge for underage drinking if they did not charge me when arrested?

In Alabama, Public Intoxication is neither a misdemeanor nor a felony, it is a "violation".  Typically, for a petty offense such as this you just pay a fine.  In some states, these records are automatically sealed so an employer cannot see them (but I'm not sure of Alabama law).  However, you may well be additionally charged for underage drinking.  This, I believe, is a misdemeanor.  You can be fined and, for a first-time offender, placed on probation.

You should consult with an attorney in your area, to check on what happens to your criminal record if you are plead guilty to either of these offenses.  The fact is an experienced DUI attorney in the area where all of this happened will know the court involved and get utilize their local contacts to your best advantage.  You don't want to have a criminal record (even one you can hopefully later clear up) if you can help.
