Can a hotel chain charge someone that broke hotel property?

Question Details:

The hotel claims that the elevator was intentionally broken; this is not true. They say they have it on video tape, but will not show it. Is this legal? They already put the charge on my friends credit card (which is $1200). I was talking to my mom on the phone, when I stated the elevator is broken and she heard me go up the stairwell because she stayed on the phone until I was in the room.

Unless the hotel has reported this  matter to the police, this is a civil, rather than a criminal matter.  Given the fact that this is a civil matter, the hotel chain can try to get your friend to pay for it, but your friend can dispute it.  Obviously, he can challenge the charge to his credit card.  If the hotel truly has proof, they may bring this matter to small claims court.  I suggest that you and your friend discuss your potential liability in detail, and perhaps with a local attorney, before determining how to proceed forward.  Good luck.
