Property Settlement - very disparate incomes and futures -
Question Details: 15 MONTHS married - Husband left home -wants divorce He is 57, fully retired, 2 million dollars in assets, retirement income 6-7,000/monrh. Wife - 54, approx. $3,500 to my name. Only social security if and when I retire. If divorce is contested, would wife receive alimony for the rest of her life? Could husband have to create a trust that would provide for her after divorce until her death as he has for himself? The wife would prefer alimony aside from everything else for her peace of mind for old age security. BUT, only married ONE year.
In a short-term marriage, alimony would not be awarded for life. Alimony may be awarded for half the length of the marriage or not at all. There are other factors which would have to be considered: did the parties live together prior to the marriage? did the wife give up income or employment at the time of the marriage? does the wife work? did the wife help the husband accumulate his assets?
