Property Line Dispute

Question Details: My neighbor has disputed a Land Survey I had done for the property line between his land and mine. The survey was accomplised by a MO licensed survey company. The line is marked with posts and signs, etc. What other action can I take to settle this problem?

I am a Missouri licensed attorney. I would need additional information to fully answer this question. When was the survey done? Do you have a copy of your contract with the surveyor? How long after the survey did your neighbor dispute the boundary? Has litigation commenced? Feel free to email me at sean@roadlawyer.net or call me at 913 441 5025 to discuss this further.

You're going to have to file what's called, in most states, an "action to quiet title."  I'm not a Missouri attorney, so the name might be different in your state and I can't help you with the procedural details.  But in simple words, the lawsuit says to the court, "I think it's my land, but the defendant disagrees.  I want my rights settled so he can't argue about it any more."

I'd hope that a licensed survey company knew its business, and that you should be able to prove your point without too much trouble.
