Question: Criminal Defense - Illinois

Asked on 11/4/2009

Pre-trial diversion

I am currently in the middle of a Federal case involving making false statements to an agent. I suggested to my lawyer on several occasions the possibility of a pre-trial diversion and he repeatedly dismissed the idea without even trying. I received a report today stating that the other female in the case, who is under the same charges, is currently on pretrial diversion. What can and should I do? I am extremely devastated and upset.

I am a lawyer in CT and practice in this area of the law.  It certainly seems odd that your lawyer would dismiss the idea of a diversionary program if you were eligible.  I cannot however, question the lawyer on this without know specifically what the police report stated.  I suggest that you take you file for a second opinion as to what happened here.  there may be more to the case against you that you are not awre of or that you were not eligible for the program based on your criminal record.  there are a lot of factors.  i suggest you obtain a second opinion.
