Question: Divorce, Marriage, Alimony - Ohio

Asked on 8/3/2009
Possession of items left in a house.
My ex moved out 5 months ago. She changed her mailing address about 2 mmonths ago. She left behind an entire bedroom set, and tons of miscellaneous furniture and clothes. I have repeatedly asked her to get her stuff out of my house, and she keeps putting it off. I want to get rid of it, the stuff is all in my garage and I can't use it anymore. Do I have the right to sell / remove her items? What would the possible repercussions be?

A lot of this depends on the status of your "ex." If you were married, then there is a separation agreement and/or divorce decree that sets forth the status of personal property. If not, then the matter gets a bit more difficult. If you "sell / remove her items," you could face various consequences, from small claims court allegations of coversion (taking someone else's property and using it for your own ends) to criminal charges.  Your best bet is to seek out an experienced and skilled local attorney who can work with you in this matter. Good luck
