Question: Criminal Defense - New Jersey

Possesion with intent to distibute,one count in the third degree.
I have been charged with intent to distibute CDS.It was one suboxone pill.It was my prescription ,in my name,and in the original container it came in.I gave a friend the pill in a Wawa parking lot.An undercover police officer said he witnessed the transaction and proceeded to arrest me.I went to court last week for a preliminary hearing.The prosecutor offered my attorney a three with a fifteen month stipulation.I think that is excessive for one pill.I have a past criminal record.I went to prison in 2001 for the same thing.I was released on ISP and completed the program without any problems.

Far more information is needed, but you must be extremely careful because, if what you're saying about having been in prison for the same thing is true, you are now in a mandatory extended term position. Basically, you are exposed to double the normal jail time if you're found "guilty" by a jury. For starters, I need to see the discovery and the grand jury transcript.
