Question Details: A photographer has decided to quit . She has taken money for a panel picture of my daughter. I had used this photographer for four years. This panel picture can't be redone since it includes my daughter's three, six, nine, and twelve month pictures. Money has exchanged hands, but I have not received the panel. My daughter is two, and there is no way to have this portrait remade. The photographer has disconnected her business phone and no longer answers her business email. She has changed her cell phone number also. I have cancelled checks to verify payments.
The only way to enforce your rights and either get the panel or your money back is to sue the photographer. If she has taken money (which you can prove) but not delivered what you contracted with for her, you should have a good case. When you sue, you could also sue for other costs or damages you've incurred.
The problem is, if the business had been an LLC or corporation and the photographer has closed it down and it no longer has assets, there may be nothing to collect--you would not be able to sue the photographer personally, if she'd worked under an LLC or inc.
