Question Details: I brought my camera to work to take pictures of a special event (it was not required of me). I let my manager use the camera and she dropped it. Now the camera won't work (point and shoot lens won't come out). The camera was not new so I told her it would cost $200 dollars to replace it (depreciated value of a $500 camera). Now she wants to replace it herself (with a used camera) or have me repair it. She is also saying if she replaces it she wants me to give her the camera. Can she do that? Is this a matter I should take up with HR? I'm not even sure I want to repair/replace with same model.
If she replaces it with a camera of the same value as yours had when she broke (e.g. a good quality used one of the same model and vintage) or pays to repair yours, she has done what she legally (and morally) should--she's made good your loss. Whether or not you'd prefer a different remedy (i..e cash in hand) is irrelevant.
If she does replace the camera, then she has a right to ask for yours--otherwise, you're being enriched by a camera.
