Question: Personal Injury - New York

Lawsuit settlement delayed.

Monies for personal injury settlement to be paid by taxi cab company, not the insurance company. Settled 30 days ago and still no payment. My lawyer doesn't know how much longer it will take. Is there a time limit for payment to be made and how can I find out? Money is not a large amount. Less than $35,000 minus lawyers cut.

If you have the usual one-third contingent fee agreement with your lawyer, you can rely on the fact that something more than $10,000 out of that money is going into the lawyer's own pocket.  So the lawyer won't let this drag on too long.  30 days is about the usual time period for a settlement to be paid (unless the settlement terms say otherwise, of course).  If it takes too much longer, your lawyer will probably file a motion to enforce the settlement.  The court will probably do just that, because courts like settlements, for a number of good reasons.
