Wht to do if our parents died almost 3 years ago and we have not been able to sell the property?
Question Details: There are 4 siblings, each holding 25% interest. Our brother recently moved in without notifying any of us. Can we still list with an agent to sell the property and is the brother living in the property responsible for upkeep, taxes, etc. until the sale of the home?
The only way you and your other siblings will be able to sell your parents' former property that each of you four (4) have title to is for you to enter into a lisitng agreement with a real estate agent to sell the property.
If not all of the four (4) agree to such then you will have to file a partition action where you ask the court to order the property be sold. For that you will need to consult with a real estate attorney to assist you in that endeavor.
