our claim was denied
Question Details: we filed an insurance claim after our trailer and truck were hit by a driver that fled on foot. After an investigation the adjuster said the claim would be paid because the witnesses and all the information pointed to their insured being at fault. Our truck was towed by them and taking from our possession. An adjuster declared the trailer a total loss. Now I am informed they will deny the claim because one of the drivers may have been the driver,,,they don't know. I told them a claim should be denied on facts not assumptions,, after all we were told they would cover the losses what can be done?
You have to get a lawyer to handle the claim for you. He or she will be able to negotiate with the insurance company, or sue them if necessary; you are definitely going to be taken much more seriously.
If they are denying the claim, they have to do that in writing, stating the reasons. Once you have that letter, you can have your attorney advise you about the likely outcome, based on all the unique facts of your case.
