Our 17 year old son was in a car accident; his fault. The other driver is sueing him. Can we be held responsible?

Question Details:

Our son rear-ended the other car. This was a low speed impact and the other driver walked away. Our son was 17 at the time with his own insurance. Can we be sued and for how much? Could we lose our house? I have no idea how to proceed.

If your son was 17 years old at the time and had his own automobile insurance and owned or leased the automobile, you may not face any liability at all.  However, because your policy is probably much more generous than his, and you are likely to have more assets with which to satisfy any eventual judgment, you should expect to be included in any lawsuit.

You should retain an attorney immediately to assist you (and your son) in protecting your home and handling any demands or possible litigation by the other party.
