Order of Protection law in Illinois for CDV charges from another State
Question Details:
In April 2008 I was arrested for CDV in Lexington, SC. I was given PTI completed and charges expunged. 14 months later my wife moves to Illinois and requests an Order of Protection for her there. I went to court and the judge ruled in her favor. OP for two years. This hearing was based solely on the CDV form SC. I feel this was double jeopardy and retried in Illinois for solely the CDV. I have had NO contact with her in any way for 16 months. How could a judge rule in her favor based on a CDV in SC that has been tried and found not guilty via Pre-Trial Intervention. Should I appeal?
Your question pertains to Illinois laws and not the laws of South Carolina. Lawyers are licensed in specific states and their knowledge of the laws is usually limited to those particular states. I do not know anything about Illinois. You should go back and ask your question for a lawyer from that state. Good luck.
