Question: Auto Accidents - Minnesota

Asked on 8/25/2009
Once I've accepted a cash settlement for bodily injury, can I withdraw on that agreemet if I feel I was coeersed into doing so
Was a pass. in an accident, where my girlfriend was driving,I was injured, was contacted by her insurance, and was conned into accepting $2000 for bodily injury and told they would still cover medical and pip benefits, and within 3 days of doing so was contacted by another adjuster whos handling the pip benefits and told they were denying my pip benefits because I was self employed, for the past 3 months and there was no tax verification for them , was paid in cash, so being there was no paper trail they aint paying. Am I screwed, can i back out of the bodily injury agreement.

Your situation represents a typical one created by insurance companies with the innocent and unknowing plaintiff.  it does not matter what state you are in. An adjuster contacts you directly and immediately after an accident and sweetalks you into a settlement, offering money up front.  People often do not realize the extent of their injuries and think they are "OK" so go ahead and settle.  In most states, it is very hard to get out of these settlements.  The language in the release is usually very specific in addressing that you are aware that you are signing off on the claim permanently and understand what you are signing.  You ask..."Am I screwed?"  My answer..."Get out your toolbox...and good luck!"  Next time, don't be so quick to sign on the dotted line. Consult with an attorney first, not afterwards.
