Question: Auto Accidents - Louisiana

On March 18, 2009, My husband was hit from behind. He was taken to the emergency room.He had whip lash. We waited for the other insurance to reach us.
They did not. We had to call them . Medical bills added to $2589.16. they tried to settled with us with a figure of $750.00 for pain and suffering with out a follow up. We decided on a follow up b/c he still hurt. Went to follow up in July. He is feeling better now.Do I have the right to get my co pay back and medications. And how much should pain and suffering be. How do I get everything paid without hiring someone. I already put my claim in.They also refuse to speak to me just my husband. Other party's Insurance company is US agencies.

I am a lawyer in CT and practice in this area of the law.   You are better off hiring a lawyer here to help your husband maximize the amount of money he can be entitled to.  You are not alowed to represent your husband becasue you are not a lawyer.  You do not know and will not know the extent of your husband's injuries.  you need to keep him treating with doctors.  I think that you will be doing your husband an injustice by not hiring a lawyer.  thats me.

Generally, if you were injured through the fault of another, you have the roght to recover all amounts you spent on treatment as a result of the accident.  In Louisiana, courts generall award damages of $1,500 to $2,500 per month for pain and suffering resulting from car wrecks such as these.  In my experience, insurance companies do not pay the full amount to individuals representing themselves.  People are usually better off hiring a lawyer to handle the matter for them so they get all they are entitled to.  I handle cases like these and you can call me for further advice.
