Question: Criminal Defense - Maryland

Asked on 8/5/2009
On a background investigation do I need to divulge cases that have been expunged?
On the background documents the forms are telling me to divulge situations even if they have been disposed of. I thought that if the items were already expunged (which I paid good money for) I should not have to speak of them?

The simple answer is no.  When a case is expunged, all records of the arrest, as well as any and all court records and reports are destroyed by virtue of the expungement, provided the expungement was completed satisfactorily.
