She claimed it under her homeowner's insurance and their legal team sent us papers that are asking for our response. Do we have to respond? Should we get a lawyer? If so, how much will it cost and can I include this cost in our lawsuit?
since you sued them you wil have to deal with the requirements of a lawsuit. if not you will lose the court case and then you get nothing. in small claims you should be able to do iut yourself. if you use atty you will not be able to add those fees to your lawsuit claim.
