Non payment of credit cards

Question Details:

When a bank has given you a credit card that you can no longer afford to pay for the lack of money, can they come and take your auto that is paid for as part of the debt that I owe them? That is what a guy from the bank told me the other day when I was talking to them about my problem. I can't pay for my house and credit cards both; my home is most important.

I am a lawyer in CT and practice in this area of the law.  I do not believe the person you spoke to is correct.  A bank is not allowed to take any property from you unless it has a security interest on it (which is not the case here) or have a judgment against.  If the bank has not gotten a judgment against you it cannot yet take your property.  even if the bank got a judgment against you, your personal vehilce is likely exempt from being levied on to satisfy the debt.  You home however, may be liened for the amount of the debt.  i suggest calling a lawyer to help you negotiate the debt or get on a payment plan.  most banks are lenient these days and will work with you to let you pay off the debt.
