Is a non-compete contract for independent contractor legal?

Question Details:

I am classified as an independent contractor, teaching music lessons at a school. Is it lawful for the school to have me sign a non-compete agreement stating that i may not teach anywhere else (school or on my own) because it would compete with the school? Isn't this kind of thing for employees?

I am a lawyer in CT and practice in this area of the the law.  A noncompete is agreement that is govered by contract law.  If is an unsual clause to have for a school, unless the school is private. In other words, if the school is private and has other private schools nearby it has an interest to making it the only place that offers your services. You are not required to sign the noncompete and you may negotiate to keep that our of your contract.   However, if this is something that the school finds important you may not have a lot of choices.
