need to start divorece papers...my husband is been deported to Italy for 5 yrs. now...i have no contact with him,no way to find him. there

Question Details: need afidavit since i cant dont know where he is? from where can i obtein that?...and we share apartament in another coutry...and i cant find him to sign the pappers to me,since he told me over a year ago he does not care of that apt. since hes in Italy and im in America..we will never see each other ....so if i add that on divorce forms, the apt...and after i put citation by publication...after divorce is finale...would that also dizolve him as part of the share i have with him on the apt. from Bucharest_Romania???....how match will cost me to hire a lawer for such a simple divorce situation

Contact an attorney. Every lawyer charges different fees, but most likely to resolve your situation would cost you somewhere from $1,500 to 5,000 in attorney fees. Also, an attorney might help you to find your husband and serve him, without the need for service by publication.

I'm not a California attorney, so I can't tell you exactly how the procedure works in your state, but basically, yes, you would need to file an affidavit, explaining when he left and how, how long it has been since you had any contact and what you have done trying to find him, to prove that you've made "diligent inquiry." That shows the court that it is fair to allow service by publication. You can put the Bucharest apartment into the papers, and the court will rule on it.  Under basic principles of international law, that should be honored in Romania, but that can't be guaranteed.
