Does my ex-husband have liability for personal injury and debt?

Question Details:

Prior to my divorce my mother let my now ex-husband borrow money to pay bills he was behind on and he verbally agreed to pay and has not. Also during our divorce he physically abused me and I have witnesses to the abuse I have had to have surgery because of the abuse-when we filed for divorce I did not claim the abuse because he had children from a previous marriage for which i care deeply for and I did not want to upset them by hurting their father. I need to know if I can make him pay the money he owes my mother plus pay my medical bills for the problems I have from the prior abuse.

I think your mother will be able to sue him for the loan.  You can't be directly involved in that, perhaps not even as a witness, because all marital debts, including this one, should have been included in your divorce.  She should start this as soon as possible;  the statute of limitations for contract cases in your state is 3 years.

For personal injury suits, such as the physical abuse, the statute of limitations is 2 years.  Even if that isn't a problem yet, there's a chance that the court would not allow you to do this since you didn't raise it in the divorce.  You should talk to a lawyer about this as soon as you can.
