Need medical records released to insurance company.

Question Details: I am the beneficiary of a life insurance policy. In order to collect on the policy, the insurance company needs medical records but will only release them to the executor of her estate. The executor refuses to retrieve medical records and send them to the insurance company, as to prevent me from collecting on policy. What other options, if any, do I have? The doctors office will not release them to me or the insurance company.

Insurance Law Law Answers

Usually life insurance doesn't pass through the will/executor of the estate -- the contract policy usually pays out directly to the beneficiary (i.e. avoids probate).  Why are medical records needed? To prove this was a natural cause and not a cause excluded under the policy like suicide or something? Usually a death certificate is sufficient. If not, you may need your own attorney to subpoena the records on your behalf and consider the following articles from Freeadvice.com:   For an attorney, try www.attorneypages.com and check his or her record at www.calbar.ca.gov under attorney search.
