My workmans comp claim is getting cancelled. Do I have a legal option?
Question Details:
They are telling me that unless I settle they are going to cancel my claim. I started taking steroids then went to cortisone shots; the doctor told me no more shots that I need surgery. What option do I have? I don't feel comfortable with surgery because of the time off work and the immobility.
It certainly seems odd that someone would tell you that your claim will be dismissed if you do not settle. This makes no sense as the insurance company for the employer cannot generally force the employee to settle a claim. Are you sure that you are understanding this correctly? Are you still treating with doctors? Have the doctors determined that you have reached maximum medical improvement? Do you have a lawyer assisting you here? I suggest that you hire a lawyer as you may be getting pressured into a premature settlement. If you do not want surgery that is your choice, but you need to know where your claim stands medically and if you are in a position to settle out. Hire a lawyer here. Most lawyers in this area charge based on a contingency fee.
