If my vehicle was parked at a gym and was broken into in the broad daylight, is the gym liable?
Question Details: I went into the gym to tell them and their response was, "That happens alI the time". To me, it just seems like they should advise their patrons.
A store, gym, mall, etc. is not responsible for the criminal acts of third parties not under its control against patrons cars unless it had specifically undertaken to provide secure parking--if it had promised or represnted that it would, but failed to do so, it might be liable for that failure. Otherwise, though, it is not responsible for what criminals who don't work for it do--that's why people have insurance, to cover losses when there is no responsible party to pay.
