Question: Auto Accidents - California

My two friends were being chased and the car that they were riding in was wrecked. What about the idiot who was chasing them?

They were going fast,  the car veered off the road, and it flipped various times. The passenger was killed at the scene. The driver, who was drinking, survived and is in jail. I understand that the driver is at fault because she was drinking and driving; but I also know the psycho boyfriend who was following behind is just as much to blame.

It's very hard to say, without quite a bit more factual detail.  But it is not at all unheard of, in situations like this, for someone threatening another person with an automobile to be charged with aggravated assault or assault with a deadly weapon.  If you have personal knowledge (as opposed to what other people might have told you) that relates to this incident, I'd suggest that you talk to the police.

I am a CA lawyer.  The passenger's family certainly has a wrongful death case.  They should contact a lawyer right away.  The driver's case is much more difficult. Since the driver was convicted of DUI, the driver's right to recovery for pain and suffering has been eliminated.  However, if the other driver (phycho boyfriend) was convicted of a felonly, that may change the outcome.  Still this is a tough case.
