Can I hide my truck from the repo man until I get the debt current?
Question Details:
My truck is due to be repossessed today. I will have money to bring debt current next week. Can I legally hide it from repo man?
If you fail to pay a lender pursuant to a contract for a motor vehilce and the lender has the right to take it back. The basis for the lender's ability to repossses the truck in this case is that it has a security interest in the truck with a lien filed with the secretary of state. When a lender decides to repossess the truck, the lender is required to go about it in a certain way - that is - it must peacefully repossess the vehicle, not threaten you and take it. It is likely that the lender will come to your house to obtain the truck. If you happen to not be there, there is no issue. If you want to avoid having to hid the truck - which I am not advising you to do - I suggest contacting the lender and asking them to hold off a week so you can pay the money. The lender should give you a week.
