My spouse drinks and drives a lot, if he hurts someone can they come after me for any kind of monetary settlement?
Question Details:
Some items in our marriage have both of our names on them. What do I stand to lose, or can they only go after him?
Anything which is jointly owned can be targetted by creditors, including cars, boats, house, joint bank accounts, etc. Creditors may only be able to get part of it--that part that represent's your spouse's portion--but they can definitely reach at least that much. Also, they can garnish his income, which could clearly have an impact on you if his income is significant to the family.
You should speak with an attorney about how best to shield some of your assets from creditors of your spouse, such as by putting them wholly in your name. Good luck.
(Another problem is that your auto insurance may not pay out in the event of DUI or DWI; check the terms and conditions of your policy.)
