Question Details: My son just told us his wife was unfaithful. What should be his first step in pursuing a divorce. He wants custody of a 2 yr. old; there's a 1 mo old , but he doesn't think he's the father. He's still living in the home. If he leaves, would that not be wise because it would be considered abandanment? He wants to come live with me and my husband and have custody of the two year old. He's the primary care giver...the mom doesn't do much. Is there an order of things that would work to his advantage in pursuing this next few weeks? Thanks for any help you can provide.

Your son should immediately consult with an attorney that handles family law matters who can give him the proper advice as to what he should do in this situation.
He should not move out of the house before he consults with a lawyer. This might be considered an abandonment of the family on his part and cause problems for him. If he leaves and takes the child with him, he could be facing kidnapping charges. He needs to consult with a lawyer before he does anything.
