My sons car insurance lapsed for 1 day. He went in the next day and paid it and it was reinstated. 3 weeks later he was in a car accident.

Question Details: The insurance company is now saying it was reinstated in error and they would not cover the accident. They returned his check and said they are not going to cover the accident. Is this legal?

Auto Accidents Law Answers

Most likely no.  This sounds like bad faith by the insurance company.  Contact your state's Department of Insurance first (you may be able to file an administrative claim) to force the company to honor the insurance policy and you should also contact an insurance bad faith attorney.
